Terms and Conditions for Use of UK Residency Website

1. Introduction

Payments made for any services, regardless of the payment location, payment currency, or method, are understood to be made solely on behalf of UKR DCS LLC or Global Mobility Technologies LLC. Users expressly acknowledge that any such payments cannot give rise to claims or legal action in the jurisdiction of payment. All disputes must be resolved exclusively under these Terms and Conditions, subject to Dubai jurisdiction and DIFC-LCIA arbitration.

These Terms apply to both registered and unregistered users and supersede any prior agreements, representations, or understandings related to the Site or its services.

2. Definitions and Interpretations

1. “Platform” refers to the technology infrastructure, services, and solutions provided through UK Residency for business consultancy, advisory, and global mobility.
2. “Services” refers to any consultancy, advisory, optimization, facilitation, or other activities conducted via the Site or in connection with the Company.
3. “User” refers to any person or entity accessing or utilizing the Site or its services.
4. “Affiliate Entities” refers to all subsidiaries, partnerships, or entities under common ownership within the UKR Group.
5. “Effective Date” is the date on which these Terms become binding upon users.

Any reference to a statutory provision includes all amendments, re-enactments, and applicable regulations.

3. Purpose and Scope of Services

The Site functions as a technology-driven platform that facilitates services related to business consultancy, foreign direct investment (FDI), and global mobility. Services provided through this platform may involve collaboration with vetted professionals and third-party partners, including independent legal and business consultants.

Nature of Services

All services rendered via the platform are consultative and facilitative. The Company does not provide legal, financial, or investment advice, and no content or communication on the Site shall be interpreted as such. Users remain solely responsible for seeking independent, case-specific professional advice.

Users expressly acknowledge and agree that UK Residency, its affiliated entities, officers, and agents provide no guarantee of specific outcomes related to any application, transaction, or service.

The use of the Site and services is provided on an “as-is” and “as-available” basis without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

4. User Obligations and Acceptable Use

5.2 Non-Refundable Payments

1. Retention of Paid Amounts:

    

   • Payments made for services are non-refundable once the corresponding milestone has been delivered.
   • Service fees are retained to cover administrative, consultative, and operational work already completed.

   • Once a milestone or service phase is completed and delivered, no refund will be provided, regardless of subsequent decisions or outcomes beyond the Company’s control.

5.3 Payment Delays and Termination

   • Users must adhere to agreed payment timelines as outlined in the invoices or service agreements.
   • Failure to remit payment by the due date may result in the following actions:
     • Immediate suspension of services.
     • Termination of the service agreement.
     • Forfeiture of any amounts previously paid.
2. Legal Recourse:

    

   • The Company reserves the right to pursue legal remedies under UAE law to recover unpaid amounts, including administrative fees, interest, and legal costs.

6. Disclaimer and Limitation of Liability

6.1 Disclaimer of Responsibility

By accessing the Site and using the services facilitated by UK Residency, you explicitly agree to waive all claims related to:

1. Consultative Services: The Company offers advisory and facilitative services only. Users are solely responsible for seeking independent professional advice.

The Company’s total liability shall not exceed the amount paid for services under dispute or AED 1,000, whichever is lesser.

7. Indemnification

Users agree to indemnify and hold harmless UK Residency, its officers, affiliates, and agents from any claims, liabilities, damages, or expenses arising from:

1. Use of the Site or services.
2. Breach of these Terms.
3. Violation of applicable laws.

This indemnification includes coverage of legal expenses incurred by the Company.

8. Confidentiality and Data Protection

The Company adheres to Dubai privacy laws regarding the collection, storage, and processing of personal data. Users consent to the Company’s data handling practices as outlined in the Privacy Policy.

Users are prohibited from disclosing proprietary or confidential information obtained through the Site.

9. Dispute Resolution and Arbitration

9.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively through binding arbitration administered by the DIFC-LCIA Arbitration Centre.

9.2 Arbitration Procedure

1. Arbitration shall be conducted in English by a single arbitrator appointed under DIFC-LCIA rules.
2. The arbitrator’s decision will be final and enforceable.
3. Costs of arbitration shall be borne by the initiating party.

9.3 Waiver of Legal Action

Users waive any right to initiate or participate in class actions or pursue legal claims outside the agreed arbitration framework.

10. Acceptance and Final Provisions

These Terms constitute the entire agreement between you and UK Residency. If any provision is found unenforceable, the remaining provisions remain valid.
